– (FR) As draftsman of the opinion on water quality, I saw that pesticides were implicated in the degradation of the environment, and particularly of surface and coastal waters, because they persist over time, can be transported over long distances, and constitute a diffuse form of pollution, which is difficult to locate resulting from runoffs, direct losses in the soil and the air, the washing of plants by the rain and so on. More generally, the current use of pesticides in our agriculture can have damaging consequences for our health.

In the opinion accepted unanimously by the Committee on Civil Liberties, Justice and Home Affairs, of which I have been the draftsman, I have, in addition to the questions raised by the Commission, emphasised the rights of children and of national minorities, and most of these issues have made their way, in the form of a compromise solution, into our report as well, thanks to the good will of the rapporteur, Mr Moscovici. Why is this so important?

Article 54 states that the contracting authorities may only take account of whether the goods or services are the most economically advantageous for that contracting authority alone. The draftsman interprets this form of words to mean that account may be taken only of advantages directly accruing to the contracting authority and that public authorities are thus deprived of their scope for using the public procurement to take account of or further the public interest.
