Must Directive 98/34/EC (1) be interpreted as precluding the imposition of penalties for the intermediation of bets on sporting competitions via a gaming machine, without a German authorisation, on behalf of a betting organiser licensed in another EU Member State, where the interventions by the State are based on a law, not notified to the European Commission, which was adopted by an individual Land and has as its content the expired Staatsvertrag zum Glücksspielwesen (State Treaty on Gaming) (‘the GlüStV’)?
La directive 98/34/CE (1) doit-elle être interprétée en ce sens qu’elle fait obstacle à la sanction de l’intermédiation de paris sportifs, effectuée sans autorisation allemande, à un organisateur de paris titulaire d’une licence dans un autre État membre de l’UE, par le biais d’une machine automatique proposant des paris, lorsque les interventions étatiques reposent sur une loi d’un Land spécifique qui n’a pas fait l’objet d’une notification à la Commission européenne et dont la teneur correspond au traité des Länder sur les jeux de hasard (Staatsvertrag zum Glücksspielwesen, ci-après le «GlüStV») qui est devenu caduque?
