Calls for the strengthening of international environmental governance through the upgrading of the United Nations Environment Program (UNEP) into a United Nations specialised agency for the environment, equipped with sufficient financial, material and human resources, with universal membership, entitled to ensure compliance with legally binding multilateral environmental agreements (MEAs) by governments, international economic institutions and transnational corporations, and serving as a r ...[+++]eference body for scientific, technical and legal expertise on the environment; calls for cohesive new action to ensure environmental sustainability, including addressing climate change as well as the issues of desertification, biodiversity and environmental refugees; calls for clarification of the jurisdictional relationship, including the dispute settlement mechanisms, between the WTO and MEAs within the UN system;

Although consolidated data on the number of decisions adopted and penalties imposed by national enforcement authorities are not available, the following representative examples can be provided: between the entry into force of the Directive and mid 2011, the Italian Competition Authority issued more than 700 decisions and applied administrative fines totalling € 91 million; the French General Directorate for Competition, Consumer Issues and Fraud Control (DGCCRF) issued 1251 Reports[124] and corresponding fines amounting to approximately € 1.7 million were imposed; [125] the Latvian Consumer Rights Protection Centre took 154 binding deci ...[+++]sions and imposed fines of € 159 400; the Finnish Consumer Ombudsman initiated 8 court cases; the Irish National Consumer Agency issued 14 undertakings, 116 compliance notices, 2 prohibition orders, and started 2 prosecutions; the Slovak Trade Inspection issued 46 administrative decisions and imposed a total amount of € 151 800 in fines; and, finally, 18 court rulings and 52 injunction orders were issued in Sweden.

The Commission cannot accept the following amendments of substance: Amendment No 5 to help Member States distinguish between national – for example non-EU derived – law and EU law. Amendments Nos 6 and 11 which try to change voluntary reporting and advice schemes to mandatory ones. Amendment No 12, second part, because it does not add anything. The proposal already refers to reports being in a readily accessible database. Amendment No 13, second part, relating to reports of site v ...[+++]isits being available within two months of inspection because the common position's wording “as soon as possible” is preferable. And Amendment No 14 which seeks to limit to brief data the compliance information in reports to the Commission, which is not sufficient for the Commission's purposes.
