Pursuant to the principle of the rule of law in criminal matters, the Court of Justice has also recently ruled (in its judgment of 3 May 2005, cases C-387/02, C-391/02 a
nd C-403/02) that a directive 'cannot, of itself and independently of a national law adopted by a Member State for its implementation, have the effect of determining or aggravating the liability
in criminal law of persons who act in contravention of the provisions of that directive' (judgment of the Court of 8 October 1987, Case 80/86, Kolpinghuis Nilmegen, reports pag

En application du principe de légalité en matière pénale, la Cour a aussi récemment précisé, dans l'arrêt cité du 3 mai 2005 (point 74), "qu’une directive ne peut pas avoir comme effet, par elle-même et indépendamment d’une loi interne d’un État membre prise pour son application, de déterminer ou d’aggraver la responsabilité pénale de ceux qui agissent en infraction à ses dispositions (voir, notamment, arrêts du 8 octobre 1987, Kolpinghuis Nijmegen, 80/86, Rec. p. 3969, point 13, et du 7 janvier 2004, X, C-60/02, non encore publié au Recueil, point 61 et jurisprudence citée)".
