The concept of double jeopardy and the prohibition on double jeopardy in Canada and in all civilized countries, I might add is based on the idea that if an assertion is made that you've done something that is not lawful, not within the bounds of the law, those who are prosecuted are allowed one shot at it, and of course, as you know, there's a proceeding in court.

I think the point has been made that not only does the law currently constructed impose a trafficking prohibition on one who simply possesses one joint of marijuana now, even before we change the law, but the same double or triple jeopardy scenario exists for a person who possesses a marijuana joint now and passes it on to another party, just as it would under the proposed legislation.

Je crois qu'on a fait valoir que non seulement la version actuelle de la loi impose une interdiction de trafic à une personne ayant en sa possession un simple joint de marijuana à l'heure actuelle, même avant que nous modifiions la loi, mais elle existe aujourd'hui pour une personne ayant en sa possession un joint de marijuana qui le fait passer à une autre personne, comme ce serait le cas en vertu du projet de loi.
