In this context it should be noted that according to a judgement of the European Court of Justice in case C-170/04 Rosengren, a provision in a national law establishing a commercial monopoly, prohibiting private individuals from importing alcoholic beverages directly without personally transporting them, constitutes a quantitative restriction on imports within the meaning of Article 28 EC, which in the particular system of the Swedish monopoly did not seem to be proportionate.
À cet égard, il convient de noter que, conformément à l’arrêt de la Cour européenne de justice dans l’affaire Rosengren (C-170/04), une disposition figurant dans une loi nationale ayant instauré un monopole à caractère commercial interdisant aux particuliers d’importer des boissons alcoolisées, sans en assurer personnellement le transport, constitue une restriction quantitative aux importations au sens de l’article 28 CE, qui, dans le système particulier du monopole suédois, ne semblait pas justifiée.
