On the above issue, the Commission considers the land in question as an asset of a mining undertaking and not as ‘real estate’, in the broad sense of the term, due to the particular characteristics of mining operations (pollution, disturbance of environment etc.), which would make the possibility of trading those assets separately from the mines questionable.
Sur cette question, la Commission envisage le terrain examiné comme l’actif d’une entreprise minière et non comme un «bien immobilier», au sens large du terme, en raison des caractéristiques particulières des activités minières (pollution, perturbation de l’environnement, etc.) susceptibles de rendre incertaine la possibilité de vendre ces actifs indépendamment des mines.
