The Court considers that, where an institution decides to refuse access to a document which it has been requested to communicate, it must, in principle, explain how disclosure of that document could specifically and effectively undermine the protected interest – in particular protection of the decision-making process of the institution and the protection of legal advice – upon which it is relying in the particular case.
La Cour considère que, lorsqu’une institution décide de refuser l’accès à un document dont la communication lui a été demandée, il lui incombe, en principe, de fournir des explications quant à la question de savoir de quelle manière l’accès à ce document pourrait porter concrètement et effectivement atteinte à l’intérêt protégé – à savoir notamment la protection du processus décisionnel de l’institution et la protection des avis juridiques – que la Commission invoque en l’espèce.
