As far as the period covered by the State‐guaranteed loan is concerned, the Commission notes that, according to the information provided by Germany, France Télécom pressed for a term of at least 18 months for the State‐guaranteed restructuring loan as a precondition for its taking over the liabilities stemming from the UMTS business, as MobilCom needed it to do, and that, consequently, a shorter term would not have been practicable without endangering the conclusion of the MC Settlement Agreement.
En ce qui concerne la durée du prêt garanti par l'État, la Commission note que d'après les renseignements fournis par l'Allemagne, France Télécom a exigé que le prêt de restructuration garanti par l'État ait une durée d'au moins dix-huit mois pour accepter de reprendre les engagements résultant de l'activité UMTS, condition essentielle pour MobilCom; la Commission relève aussi qu'une durée inférieure aurait compromis la conclusion de l'accord de règlement MC.
