Moreover, and very importantly, the Council Decision clarifies explicitly that only certain articles of the Regulation on Ship Recycling provide for the alignment with the Convention: Articles 5(9) [sic!] for the update of the inventory of hazardous materials, Article 7(2) on the ship recycling plan, Article 10(1) and 10(2) on inventory certificates, and Articles 12(1) and 12(3) with regard to the requirement for ships flying the flag of a third country to have on board an inventory of hazardous materials.
Par ailleurs, et surtout, la décision du Conseil précise sans équivoque que seuls certains articles du règlement sur le recyclage des navires prévoient une harmonisation avec la convention: l'article 5, paragraphe 9 [sic], concernant l'actualisation de l'inventaire des matières dangereuses, l'article 7, paragraphe 2, relatif au plan de recyclage du navire, l'article 10, paragraphes 1 et 2, portant sur les certificats d'inventaire, et l'article 12, paragraphe 1 et 3, eu égard à l'exigence applicable aux navires battant pavillon d'un pays tiers de conserver à bord un inventaire des matières dangereuses.
