Transnational lists are meant to increase the role of political parties at European level and to trigger campaign activities which would focus on issues that go beyond national interests and highlight European questions and debates.

Furthermore, paragraph 4 provides that a de-listing at UN level will automatically trigger a de-listing at EU level, which is in line with the data protection principle that personal data should be kept up to date, as provided for in Article 4(1)(d) of Regulation (EC) No 45/2001.

A broad gamut of solutions is available, ranging from the consent of the data subject (paragraph 6(a)) and the exercise of legal claims (paragraph 6(d)) — which could be useful in case the information has been provided by the listed person with a view to trigger a review of the listing — to the existence within the UN of mechanisms to ensure an adequate protection for personal data transmitted from the EU.

To this end, the Commission may be notified until 25 August 2004 of the studies currently being conducted to establish whether ingredients or substances, derived from ingredients listed in Annex IIIa are not likely, under specific circumstances, to trigger adverse reactions.

A mechanism is triggered whereby if a non-EU country on the positive list introduces visa requirements for the nationals of one (or more) Member State(s), the latter should inform the Commission and the Council and a specific procedure is implemented with a view to restoring visa-free travel.
