In its judgment of 16 December 1975 in relation to the European Sugar Cartel; Joined Cases 40 to 48, 50, 54 to 56, 111, 113 and 114/73 Suiker Unie and others v. Commission (13), the Court of Justice held that the criteria of coordination and cooperation laid down by the case-law of the Court, which in no way requires the working out of an actual plan, must be understood in the light of the concept inherent in the provisions of the Treaty relating to competition that each economic operator must determine independently the commercial policy which he intends to adopt in the common market.
Dans son arrêt du 16 décembre 1975 dans l'affaire sur l'entente européenne concernant le sucre [affaires jointes 40 à 48, 50, 54 à 56, 111, 113 et 114-73, Suiker Unie et autres/Commission (13)], la Cour a soutenu que les critères de coordination et de coopération définis dans sa jurisprudence, qui n'exige en aucune façon l'élaboration d'un véritable plan, doivent être compris à la lumière de la conception inhérente aux dispositions du traité relatives à la concurrence, selon laquelle tout opérateur économique doit déterminer de manière autonome la politique qu'il entend suivre sur le marché commun.
