La BCE a compétence pour émettre un avis en vertu de l'article 105, paragraphe 4, du traité instituant la Communauté européenne dans la mesure où la proposition de décision affecte la structure et les fonctions de l'un des comités de l'UE compétents en matière de services financiers et touche au rôle confié au Système européen de banques centrales (SEBC) de contribuer à la bonne conduite des politiques en ce qui concerne le contrôle prudentiel des établissements de crédit et la stabilité du système financier, tel que visé à l'article 105, paragraphe 5, du traité.
