(5.1) Where, in the taxation year in which a taxpayer dies, an amount is included in computing the taxpayer’s income by virtue of paragraph 23(3)(c) of the Income Tax Application Rules, the provisions of subsection 159(5) apply, with such modifications as the circumstances require, as though the amount were an amount included in computing the taxpayer’s income for the year by virtue of subsection 70(2) or an amount deemed to have been received by the taxpayer by virtue of subsection 70(5).
(5.1) Lorsque, au cours de l’année d’imposition au cours de laquelle un contribuable décède, un montant est inclus dans le calcul de son revenu en vertu de l’alinéa 23(3)c) des Règles concernant l’application de l’impôt sur le revenu, les dispositions du paragraphe (5) s’appliquent, avec les adaptations nécessaires, comme si ce montant était un montant inclus dans le calcul de son revenu pour l’année en vertu du paragraphe 70(2) ou un montant réputé avoir été reçu par lui en vertu du paragraphe 70(5).
