For the purposes of sections 342 and 354 and paragraph 356(1)(b), the offence of having in possession is complete when a person has, alone or jointly with another person, possession of or control over anything mentioned in those sections or when he aids in concealing or disposing of it, as the case may be.

I would like to add that the excellent recent edition by Madam O'Brien and Monsieur Bosc of the House of Commons Practice and Procedure states very clearly as precedents the following forms of contempt found by the 1999 report of the United Kingdom Joint Committee on Parliamentary Privilege: deliberately publishing a false or misleading report of the proceedings of the House or a committee; or deliberately altering, suppressing, concealing or destroying a paper required to be produced for the House or a committee.

The key point here, following the hearing held jointly by the Committee on Economic and Monetary Affairs and the Committee on Civil Liberties, Justice and Home Affairs last October, is the briefing of the ‘Article 29’ working group which, on 22 November 2006, clearly confirmed our concerns, namely that, in the SWIFT case, data that should manifestly not have been concealed from the US authorities had in fact been concealed and that, accordingly, the 1995 Directive had not been complied with.

Similarly, with respect to the new trafficking offences, it seems to us that the current possession offences under section 354 are sufficient, particularly bearing in mind the provision in section 358: " Possession is complete when a person has, alone or jointly with another person, possession or control over anything . or when he aids in concealing or disposing of it" .
