14. Is extremely concerned at the sharp rise in cases of BSE in Portugal and the results of the two inspection missions in that country and notes the decision adopted by the Commission on 18 November to ban the export of live bovine animals, mammalian meat-and-bone meal and, until 1 August 1999, beef and veal and beef and veal products from Portugal;

(4) Whereas the Scientific Steering Committee adopted an opinion on safety of gleatine on 26 and 27 March 1998 which was updated on 18 and 19 February 1999; whereas this opinion addresses the questions under which conditions of sourcing of the material and/or of type of material used and/or production process gelatine destined for human consumption can be considered free of bovine spongiform encephalapathy (BSE) infectivity; whereas in this opinion, the Scientific Steering Committee distinguishes the recommended measures between dif ...[+++]ferent categories of geographical risk; whereas a final implementation can only follow after classification of countries and regions; whereas on 21 May 1999, at the general session of the International Office of Epizootics (IOE) Committee, a proposal of the IOE International Animal health Code Commission concerning the criteria for the determination of the BSE status of a country or zone was adopted; whereas in accordance to the procedure laid down in Commission Recommendation 98/477/EC(6), concerning information necessary to support applications for the evaluation of the epidemiological status of countries with respect to transmissible spongiform encephalopathies, certain Member States and third countries submitted data necessary to allow assessment of their geographical risk; whereas, considering recent development of the IOE Code on BSE, pending the above scientific assessment and the subsequent decision making, the entry into force of rules for the production of gelatine derived from ruminant bones should be suspended until Community legislation concerning classification of countries or regions as regards their BSE status is applicable; whereas the Commission will initiate the procedure for the entry into force of rules for the production of gelatine derived from ruminant bones without delay after the adoption of Community legislation concerning classification of countries or regions as regards their BSE status;

(3) Whereas missions on BSE-related issues have been carried out in Portugal by the Commission Office for Veterinary and Phytosanitary Inspection and Control from 7 to 12 July 1996 and by the Food and Veterinary Office of the Commission from 15 to 21 June 1997 and from 11 to 15 May 1998; whereas those missions contributed to the assessment of the application and effectiveness of measures to protect against BSE; whereas those missions concluded that, despite important improvements, not all risk factors were adequately managed; whereas a follow-up mission was conducted by the food and Veterinary Office from 28 September to 2 October 199 ...[+++]8; whereas that mission confirmed most of the findings of the previous missions and observed, despite an overall improvement, certain continued shortcomings in the enforcement of the measures to control the risk factors; whereas the sharp increase in the incidence of BSE, in particular since June 1998, raises serious concerns with regard to the development of the disease in the near future; whereas on the basis of that mission it is concluded that due to deficiencies existing until very recently in the implementation of Community legislation on identification and registration of animals, and of measures on TSE surveillance and BSE eradication, no adequate guarantees can be provided regarding the BSE history of the herds of origin and herds through which bovine animals pass and regarding the dams of bovine animals;
