(b) an institution controls a trust, fund or partne
rship (other than a limited partnership) or an unincorporated association or organization, if more than fifty per cent of the ownership
interests, however designated, into which the trust, fund,
partnership, association or organization is divided are beneficially owned by the institution and the institution is able to direct the business and affairs of the trust, fund,
partnership, associat ...[+++]ion or organization; and
b) dans le cas d’une fiducie, d’un fonds, d’une société de personnes, à l’exception d’une société en commandite, d’une organisation ou association non dotée de la personnalité morale, l’institution qui en détient, à titre de véritable propriétaire, plus de cinquante pour cent des titres de participation — quelle qu’en soit la désignation — et qui a la capacité d’en diriger tant l’activité commerciale que les affaires internes;
