In its judgment delivered today, the Court notes, first of all, the three conditions which must be satisfied if a VAT exemption is to be granted for an intra‑Community supply of goods: (i) the right to dispose of the goods as owner must have been transferred to the purchaser; (ii) the vendor must establish that the goods have been dispatched or transported to another Member State; and (iii) as a result of that dispatch or transport, the goods must have physically left the territory of the Member State of supply.
Dans son arrêt de ce jour, la Cour rappelle, tout d’abord, les trois conditions requises pour bénéficier de l’exonération de la TVA sur la livraison intracommunautaire d’un bien. Premièrement, il est nécessaire que le droit de propriété de ce bien soit transmis à l’acheteur. Deuxièmement, le vendeur doit établir que le bien a été expédié ou transporté vers un autre État membre. Troisièmement, à la suite de cette expédition ou de ce transport, le bien doit quitter physiquement le territoire de l’État membre d’expédition.
