The Board of Appeal pointed out, first, that it is clear from Article 4 of Regulation No 40/94 that the shape of a product may be registered as a Community trade mark, provided that the shape displays certain features that are sufficiently unusual and arbitrary to enable the relevant consumers to recognise the product, purely on the basis of its appearance, as emanating from a specific undertaking.
Ladite chambre a, tout d’abord, relevé qu’il résulte de l’article 4 du règlement n° 40/94 que la forme d’un produit peut être enregistrée comme marque communautaire, à condition de présenter des caractéristiques suffisamment inhabituelles et arbitraires pour permettre aux consommateurs concernés de reconnaître ce produit, sur la base de son seul aspect, comme provenant d’une entreprise donnée.
