Under the Commission's decision, DSD may therefore no longer charge a fee in Germany for that part of the sales packaging bearing the "Green Dot" for which it can be shown that the take-back and recovery obligation, as set out in the German packaging ordinance, has been properly fulfilled by another party, be that a competing system or a self-management solution.
Selon la décision de la Commission, DSD ne peut par conséquent plus faire payer de redevance en Allemagne pour la partie des emballages de vente portant le logo "Point vert" pour laquelle il peut être prouvé que l'obligation de reprise et de valorisation prévue par le décret allemand sur les emballages a été dûment exécutée par une autre partie, qu'il s'agisse d'un système concurrent ou d'une solution individuelle.
