Toutefois, en l'absence de liste officielle, la Commission adopte une approche au cas par cas qui tient compte, d'une part, des données scientifiques existantes concernant le risque d'eutrophisation des eaux maritimes réceptrices des bassins hydrographiques concernés (données reconnues par les conventions internationales signées par ces pays : convention d'Helcom pour la mer Baltique, convention d'Ospar pour la mer du Nord, convention de Barcelone pour la Méditerranée, conventions du Danube et de la mer Noire pour la mer Noire) et, d'autre part, de la localisation et des caractéristiques des projets ISPA.
