Since the Spanish authorities have not provided scientific evidence to support their position and, according to the Commission's information, similar products (energy drinks and ice creams) containing guarana are freely marketed elsewhere in Spain, the Commission is of the opinion that the ban imposed by the Autonomous Community of Valencia is disproportionate to its aim, that of protecting people's health.
Faute d'éléments scientifiques de la part des autorités espagnoles permettant de prouver le bien fondé de leur position, et compte tenu du fait que, sur base des informations dont la Commission dispose, des produits similaires (boissons énergétiques et glaces) qui contiennent du guarana sont commercialisées librement ailleurs en Espagne, la Commission estime que l'interdiction imposée par la Communauté autonome de Valencia est disproportionnée par rapport au but, de protection de la santé des personnes, qu'elle vise à atteindre.
