Clause 5 of this bill would add new section 12.1 to the State Immunity Act, which provides that in the event that a judgment is rendered against a foreign state for engaging in terrorist conduct, the Minister of Finance and the Minister of Foreign Affairs shall, at the request of the party to the proceedings, assist to the fullest extent practicable, any judgment creditor or the court in identifying, locating and executing against the property of the foreign state, its agents and its instrumentalities.
L'article 5 de ce projet de loi ajouterait à la Loi sur l'immunité des États l'article 12.1, qui prévoit que si une partie a gain de cause à l'encontre d'un État étranger ayant adopté un comportement terroriste, le ministre des Finances et celui des Affaires étrangères doivent, à la demande de la partie à l'instance, dans toute la mesure du possible, aider le créancier bénéficiaire du jugement ou le tribunal à identifier et localiser les biens de cet État ou d'un organisme ou personne morale de droit public de celui-ci, et à exécuter le jugement contre ces biens.
