Decisions to reassign officials in the interest of the service, taken on the basis of Article 7(1) of the Staff Regulations, have as their purpose the proper functioning of the service, even where they are justified by internal relationship difficulties, and therefore come within the broad discretion which the institutions have to organise their departments to suit the tasks entrusted to them and to assign the staff available to them in the light of such tasks, provided that such assignment conforms with the principle of assignment to an equivalent post.
Les décisions de réaffectation dans l’intérêt du service, prises sur le fondement de l’article 7, paragraphe 1, du statut visent au bon fonctionnement du service, même lorsqu’elles sont justifiées par des difficultés relationnelles internes, et relèvent, par conséquent, du large pouvoir d’appréciation des institutions dans l’organisation de leurs services, en fonction des missions qui leur sont confiées, et dans l’affectation, en vue de celles-ci, du personnel qui se trouve à leur disposition, à condition que cette affectation se fasse dans le respect de la correspondance entre l’emploi et le grade.
