If, as has been noted at paragraph 61 above, an exception to that fundamental right has been allowed with regard to initial decisions to freeze funds, that is justified by the need to ensure that the freezing measures are effective and, in short, by overriding consid
erations to do with safety or
the conduct of the international relations of the Union and of its Member States (see, to this effect, Kadi and Al Barakaat Interna
tional Foundation v Council and Commission, par ...[+++]agraph 342).
Si, ainsi qu’il a été rappelé au point 61 du présent arrêt, une exception audit droit fondamental a été admise pour ce qui concerne les décisions initiales de gel de fonds, celle-ci se justifie par la nécessité d’assurer l’efficacité des mesures de gel et, en définitive, par des considérations impérieuses touchant à la sûreté ou à la conduite des relations internationales de l’Union et de ses États membres (voir, en ce sens, arrêt Kadi et Al Barakaat International Foundation/Conseil et Commission, précité, point 342).
