...[+++] for the Protection of Unborn Children Ireland Ltd, l'avocat général Van Gerven a proposé d'admettre "qu'une réglementation nationale qui, pour demeurer compatible avec le droit [de l'Union], doit se référer à des notions juridiques telles que les raisons impérieuses liées à l'intérêt général ou à l'ordre public (...) se situe "dans le cadre" du droit [de l'Union]" au motif que, bien que ces notions d'intérêt général et d'ordre public puissent être définies dans une large mesure par les États membres, leur portée dans le cas de mesures relevant du droit de l'Union reste néanmoins soumise au contrôle de l'Union et elles doivent être "justifiées et délimitées d'une manière uniforme pour l'ensemble de [l'Union] en fonction du droit [de l'Union], c'est-à-dire en tenant compte également des principes généraux relatifs aux droits et libertés fondamentaux";
