Ces questions ont été soulevées dans le cadre d'un litige opposant neuf compagnies d'assurances et la compagnie Réunion européenne, apéritrice (ci-après les «assureurs»), subrogées dans les droits de la société Brambi fruits (ci-après «Brambi»), qui a son siège à Rungis (France), à Spliethoff's Bevrachtingskantoor BV, qui a son siège à Amsterdam (Pays-Bas), et au capitaine commandant le navire Alblasgracht V002, domicilié aux Pays-Bas, à la suite de la constatation d'avaries, lors de la livraison à Brambi d'un chargement de 5 199 cartons de poires dans le transport duquel sont intervenus les défendeurs.
