In the present instance, actions were brought before the Raad van State (Council of State, Netherlands) concerning permits for the construction and operation of three power stations fuelled by pulverised coal and biomass, namely the permit granted to RWE Power AG for a power station in Eemsmond, in the province of Groningen, and two permits granted respectively to Electrabel Nederland N.V. and E.On Benelux N.V. relating to power stations in Rotterdam, in the province of Zuid-Holland.
En l'espèce, le Raad van State (Conseil d'État, Pays-Bas) a été saisi de litiges concernant des autorisations en vue de la construction et l'exploitation de trois centrales électriques fonctionnant au charbon pulvérisé et à la biomasse. Il s'agissait, en particulier, de l'autorisation délivrée à la société RWE Power AG pour une centrale à Eemsmond, province de Groningen, et de deux autorisations délivrées respectivement à la société Electrabel Nederland N.V. et à E.On Benelux N.V., concernant des centrales à Rotterdam, province de Zuid-Holland.
