I should specifically like to draw your attention to the following fact; the United States has been able, by means of an internal regulation, to implement a regulation, the so-called Qualified Intermediary Agreement, by virtue of which the Swiss banks and those from other countries are obliged to communicate to the Internal Revenue Service profits made by an American client – a US person – from assets which are also American, to lift banking secrecy with regard to these payments or even to apply a deduction at source of 30%.
Concrètement, je souhaite attirer votre attention sur le fait suivant : les États-Unis ont réussi, par le biais d’une réglementation interne, à imposer une régulation, que l’on nomme Qualifyed intermediary agreement, en vertu de laquelle les banques suisses et celles des autres pays sont obligées de communiquer à l’Internal Revenue Service les rendements concédés à un client américain - une US person - provenant d’un actif également américain, de lever le secret bancaire en ce qui concerne ces paiements ou bien d’appliquer une retenue de 30 %.
