Procter Gamble maintains that, contrary to the finding of the Court of First Instance, the square or triangular inlays on the upper surface of these tablets are not obvious solutions but perceptibly alter the tablets’ appearance and therefore at least play a part in influencing the way in which the consumer perceives them.
