Whereas a clear distinction between a contract for participation in or allowing for use of a system and the supply of the technical equipment itself is appropriate, the latter being subject to normal contract law, thus allowing a system vendor to claim his direct costs in the case of the termination of a participation or subscription contract in accordance with the provisions of this Regulation;
considérant qu'il convient d'opérer une distinction claire entre un contrat de participation ou un contrat avec un abonné à un système ou un contrat autorisant l'utilisation d'un tel système et un contrat de fourniture de l'équipement technique, ce dernier étant régi par les dispositions normales du droit conventionnel, de façon à permettre ainsi à un vendeur de système de récupérer ses coûts directs en cas de résiliation d'un contrat de participation ou conclu avec un abonné de souscription, effectuée conformément aux dispositions du présent règlement;
