By derogation from paragraphs 1 and 2, Austria may, as long as the tax system in the Swiss enclave of Samnauntal differs from that applicable in the rest of the Kanton of Graubünden, limit the application of the lower quantitative limit to tobacco products brought into the territory of that Member State by travellers who enter its territory directly from the Swiss enclave of Samnauntal.

Il résulte de la législation phytosanitaire suisse que les cantons de Berne et des Grisons ne sont plus reconnus zone protégée en Suisse en ce qui concerne Erwinia amylovora (Burr.) Winsl. et al. Il convient dès lors que la dérogation en vertu de laquelle certaines importations en provenance de ces régions sont autorisées à destination de certaines zones protégées moyennant le respect d'exigences particulières soit supprimée et que la partie B de l'annexe IV de la directive 2000/29/CE soit modifiée en conséquence.
From the Swiss legislation on plant protection, it appears that the Cantons of Berne and Grisons are no longer recognised as a protected zone for Erwinia amylovora (Burr.) Winsl. et al. in Switzerland. The derogation allowing certain imports from those regions into certain protected zones under special requirements should therefore be deleted and Part B of Annex IV to Directive 2000/29/EC should be amended accordingly.
