Les États membres et les pouvoirs publics restent libres de fournir eux-mêmes ces services à caractère social ou de les organiser d’une manière qui n’en implique pas la mise en concession, par exemple, en se limitant à financer ces services ou en octroyant des licences ou autorisations à tous les opérateurs économiques remplissant les conditions préalablement définies par le pouvoir adjudicateur ou l’entité adjudicatrice, sans fixation de limites ou de quotas, à condition que de tels systèmes garantissent une publicité suffisante et respecte les principes de transparence et de non-discrimination.
Member States and/or public authorities remain free to provide these services themselves or to organise social services in a way that does not entail the conclusion of concessions, for example through the mere financing of such services or by granting licences or authorisations to all economic operators meeting the conditions established beforehand by the contracting authority or contracting entity, without any limits or quotas, provided such systems ensure sufficient advertising and complies with the principles of transparency and non-discrimination.
