Finn, in a recent and unpublished judgment, Madam Justice Arbour stated, “Nor can the provision be infused with reasonableness in a constitutional sense on the basis of an assumption that the prosecution will behave honourably—” She went on to say that, “'The protection of basic rights should not be dependent upon a reliance on the continuous exemplary conduct of the Crown, something that is impossible to monitor or control'.
