7. Notes that the Directorate-General for Infrastructure drew up an action plan in 2009 in response to the main recommendations made by the internal auditor concerning the management and conservation of works of art; wishes to be informed of the progress made in the annual activity report for 2011;

The conference will work on ways to preserve, promote and protect our heritage by: identifying and maintaining various tangible and intangible artifacts that represent African culture — dance, folklore, fine art, literature, oral traditions and history; creating economic initiatives and tourism strategies that capitalize on cultural and historical assets; helping people and communities of African descent maintain their distinct heritage and culture; and promoting destinations and historic sites of the African diaspora.

Since the objectives of the action to be taken (the preservation and knowledge of cultural heritage of European significance, transnational mobility of cultural players in Europe, transnational circulation of works of art and cultural and artistic products and intercultural dialogue) cannot be sufficiently achieved by the Member States owing to their transnational character, and can therefore be better achieved at Community level, the Community may adopt measures, in accordance with the principle of subsidiarity as set out in in Article 5 of the Treaty.

The results showed that the Member States: (i) are not aware of any cross-border problems related to the implementation of the Directive (which does not have a significant cross-border dimension); (ii) widely make use of the derogations provided by the Directive (i.e. the exemption for services, sales by auction and sales of works of art and antiques and the temporary derogation to apply the Directive to small businesses); (iii) support minimum harmonisation in this field (more than 10 Member States have introduced or maintained national rules providing a higher level of consumer protection as regards the price indication).
