Selon la même doctrine, lorsque des accords sont conclus en application des articles 24 ou 38 du Traité sur l'Union en matière de politique étrangère et de sécurité commune ou de coopération policière et judiciaire en matière pénale par le Conseil, les effets juridiques ne visent que les Etats membres individuellement et les modalités et conditions prévues en droit national quant à leurs conclusion et ratification restent d'application (Art. 24, 1er sous-paragraphe, 3ème phrase, TUE).
Expert opinion also contends that where agreements are concluded by the Council under Articles 24 or 38 of the Treaty on European Union in the sphere of the common foreign and security policy or police and judicial cooperation in criminal matters, the legal effects apply only to the Member States individually and the terms and conditions laid down by national law concerning their conclusion and ratification continue to apply (Article 24, first subparagraph, third sentence, TEU).
