Certain rope manufacturers have argued that since HTY is predominantly used within other sectors, such as the industrial sector and the car industry, the imposition of anti-dumping measures would lead to a lack of availability of the types of HTY used by the ropes manufacturers, since the Union producers would allegedly focus on the big markets first and supply the remaining sectors only if spare capacity existed.

Cette procédure a été ouverte à la suite d’une plainte déposée le 27 juillet 2009 par le Comité international de la rayonne et des fibres synthétiques (CIRFS, ci-après «le plaignant») au nom de producteurs de fils de polyesters à haute ténacité représentant une proportion majeure, en l’occurrence plus de 60 %, de la production totale de fils de polyesters à haute ténacité réalisée dans l’Union.
