- les juridictions nationales devant statuer sur des actions en dommages et intérêts concernant une pratique visée à l'article 81 ou 82 sur laquelle une ANC du REC a déjà rendu une décision définitive concluant à l'existence d'une infraction à ces articles, ou sur laquelle une instance de recours a rendu un jugement définitif confirmant la décision de l'ANC ou constatant elle-même une infraction, ne peuvent prendre des décisions qui iraient à l'encontre de cette décision ou de ce jugement.
- national courts that have to rule in actions for damages on practices under Article 81 or 82 on which an NCA in the ECN has already given a final decision finding an infringement of those articles, or on which a review court has given a final judgment upholding the NCA decision or itself finding an infringement, cannot take decisions running counter to any such decision or ruling.
