La Cour juge que, lorsque le tribunal saisi en second lieu est celui de l’État membre où l’immeuble est situé et bénéficie ainsi d’une compétence exclusive, il n’a ni à surseoir à statuer ni à se dessaisir au profit de la juridiction saisie en premier lieu, mais doit statuer au fond sur la demande dont il est saisi.
The Court holds that, where the court second seised is the court of the Member State in which the property is situated and thus has exclusive jurisdiction, it is not required either to stay its proceedings or to decline jurisdiction in favour of the court first seised, but must give a ruling on the substance of the action before it.
