(3) Under subsection 2(1) of the Indian Act, R.S.C. 1985, c. I-5: an “Indian” is a person who is either registered or entitled to be registered under the legislation; the term “reserve” means a tract of land to which the federal Crown holds title but that is “set apart by Her Majesty for the use and benefit of a band”; a “band” is a “body of Indians” for whose common use and benefit lands have been set apart or moneys are held, or that is declared to be a band by the Governor in Council.
