This argument has been fully accepted by the WTO panel report. The report states that whisky, brandy, rum, gin, genever and liqueurs are 'directly competitive or substitutable' with shochu, and that Japan is in breach of Article III. 2 of the GATT by taxing them in a way which protects domestic products.
