Le 20 octobre 1994, la requérante a déposé une plainte auprès de la Commission, d'une part, contre le comportement de Belgacom, en vertu de l'article 3 du règlement n° 17 du Conseil, du 6 février 1962, premier règlement d'application des articles 85 et 86 du traité (ci-après «règlement n° 17»), pour violation de l'article 86 du traité et, d'autre part, contre le cadre réglementaire belge pour incompatibilité avec les articles 86 et 90, paragraphe 1, du traité.
On 20 October 1994 the applicant submitted a complaint to the Commission in which it claimed, first, under Article 3 of Regulation No 17 of the Council · First Regulation implementing Articles 85 and 86 of the Treaty (hereinafter 'Regulation No 17'), that Belgacom's conduct infringed Article 86 of the Treaty and, second, that the relevant Belgian provisions were incompatible with Articles 86 and 90(1) of the Treaty.
