(a) the accused may be represented by counsel; (b) the accused is entitled to an Appeal to the newly created Summary Appeal Court; (c) the Summary Appeal Court is presided by civilian judge, assisted by two military members who are officers or warrant officers; and (d) as a general rule, imprisonment or service detention cannot be imposed where the offender is not legally represented in that court or in a court martial.

This regulation, known as Rome I, works alongside two other regulations, Rome II (non-contractual obligations) and Rome III (divorce and legal separation) to determine the applicable law in different types of civil and commercial matters.

The Commission will take account of any needs in connection with the existing instruments or work in progress on civil and criminal judicial cooperation, such as the work of the implementation of the European Judicial Network in civil and commercial matters, for the coordination of legal proceedings through EUROJUST, the mutual recognition of final decisions in criminal matters [15] or the mutual recognition of judgments on civil and commercial matters.
