C'était très intéressant hier de discuter avec le professeur Andrew Burrows, auteur du Burrows Report, qui a été préparé pour la Law Reform Commission du Royaume-Uni. L'auteur y conclut que la responsabilité conjointe et solidaire est fondée sur le principe fondamental de l'équité et sur la capacité du plaignant d'être indemnisé intégralement, restitutio in integrum, et que, sur la base de son analyse juridique, pour assurer l'équilibre en matière d'équité il faut s'en tenir au statu quo.
It was quite interesting yesterday talking with Professor Andrew Burrows, the author of the Burrows Report which was prepared for the Law Reform Commission in the U.K. That report concluded that joint and several liability was founded on the fundamental principle of fairness and the ability of a plaintiff to be indemnified in whole, restitutio in integrum, and that, based on his legal analysis, the balance of fairness was to stay with the status quo.
