Set up in 2009, as an initiative of the Council and the Commission to address the growing threat of trade in counterfeit and pirated goods, the European Observatory on Counterfeiting and Piracy became a centre of expertise for gathering, monitoring and reporting information and data related to intellectual property rights (IPRs) infringements and a platform for cooperation between representatives from national authorities and stakeholders to exchange ideas on best practices in view of developing enforcement strategies in terms of IPR.

The Council’s conclusions confirmed the need to make IPR enforcement work better within the Single Market by complementing legislation with a range of non-legislative measures.

It has harmonised the laws of Member States with regard to civil measures for the enforcement of all IPR and a proposal on criminal sanctions is currently under discussion in the Council[6].

Firmly believes that the legal uncertainty and high costs currently prevailing in the field of IPR contribute to fragmentation of research efforts in Europe; urges therefore the Commission to proceed to an impact assessment of the different legal instruments that can be used to reduce existing barriers to knowledge transfer within the ERA; notes that properly registered inventions can be an important source of knowledge and that legislation on IPR protection, including EU patent law, cannot be a barrier to knowledge-sharing; highlights the vital importance of establishing a Community Patent and a high-quality, cost-effective, innovation-friendly judicial system for European patents which respects the competence of the Court of Justic ...[+++]e of the European Communities; notes the Communication from the Commission to the European Parliament and the Council on enhancing the patent system in Europe (COM(2007)0165); notes that the resulting legal framework will provide better incentives for private business involvement in research and will strengthen the position of EU innovators at the international level;

Therefore calls on the Serbian Government to pursue its efforts to implement the Sarajevo Declaration, including by adopting a clear legal framework covering, inter alia, the right to return to the place of origin and the right to property compensation; urges the EU, its Member States and the international community to remain committed to upholding the rights of refugees, and to provide continuing support to the countries in question, including by earmarking sufficient financial resources to that end; emphasises that the integration or resettlement of IDPs and refugees should not significantly alter the original ethnic balance of an area or region; in this respect, draws attention to the Council of Europe's Frame ...[+++]work Convention on the Protection of Minorities (1995);
