1. Un établissement de crédit n’agissant pas en tant qu’initiateur, sponsor ou prêteur initial n’est exposé au risque de crédit d’une position de titrisation incluse dans son portefeuille de négociation ou en dehors de celui-ci que si l’initiateur, le sponsor ou le prêteur initial a communiqué expressément à l’établissement de crédit qu’il retiendrait en permanence un intérêt économique net significatif qui, en tout cas, ne sera pas inférieur à 5 %.
1. A credit institution, other than when acting as an originator, a sponsor or original lender, shall be exposed to the credit risk of a securitisation position in its trading book or non-trading book only if the originator, sponsor or original lender has explicitly disclosed to the credit institution that it will retain, on an ongoing basis, a material net economic interest which, in any event, shall not be less than 5 %.
