La position commune du Conseil a opéré une confusion sur la question du libre choix: i) elle accepte l'amendement n° 2 du PE et l'intègre dans un nouveau considérant 5 mais la formulation en a été modifiée, ce qui change l'essence de l'amendement 2; ii) elle ajoute un nouveau paragraphe 2 aux notifications de l'article 9 sans assortir le libre choix d'aucune condition; iii) elle ajoute une clause de révision à l'article 23, qui est en partie une réponse à l'amendement 21 du PE, mais avec une période transitoire de 7 ans.
The Common Position of the Council has confused the issue of optionality by the following means: i) it accepts EP Am 2 in part as a new recital 5 but the wording has been modified and has distorted the essence of Am 2; ii) it adds a new paragraph 2 on notifications to Article 9 without attaching any conditions to optionality; iii) it adds a revision clause in Article 23, which is partly a response to EP Am 21, but with a transitional period of 7 years.
