À cet égard, il convient de souligner que la jurisprudence dont fait état la requérante, aux termes de laquelle il a été jugé que l’institution n’était pas autorisée à substituer une motivation entièrement nouvelle à la motivation initiale erronée (arrêt Berlingieri Vinzek/Commission, précité, point 79), vise l’hypothèse particulière dans laquelle l’institution fournit des motifs complémentaires après l’introduction du recours et n’est donc pas applicable à la phase précontentieuse.
In that regard, it should be emphasised that the case-law on which the applicant relies, under the terms of which it was held that the institution was not entitled to substitute an entirely new statement of reasons for the initial, erroneous, statement (Berlingieri Vinzek v Commission, cited above, paragraph 79), relates to the specific situation in which the institution provides supplementary reasons after the appeal has been brought and is not therefore applicable to the pre-litigation stage.
