It is necessary to provide for transitional arrangements enabling Member States to authorise the placing on the market and putting into service of such machinery manufactured in accordance with national provisions in force upon adoption of this Directive, including those implementing the Convention of 1 July 1969 on the Reciprocal Recognition of Proofmarks on Small Arms.

The Commission has also sent a reasoned opinion to the French authorities requiring them to amend national law on the marketing of articles in precious metals, manufactured or released for free circulation in another Member State and already bearing the manufacturer’s mark and a fineness mark registered in that other State.

It also considers that the requirement that the manufacturer’s mark be registered is unjustified, insofar as it should be possible to identify the manufacturer if the article bears a manufacturer’s mark affixed in accordance with the legislation of the Member State of origin.

This includes principally the Waste Framework Directive [111], which requires Member States to ensure that waste is treated without endangering human health or the environment, lays down permitting and inspection obligations and to adopt waste management plans, the Landfill Directive [112] which sets requirements for safe landfill and the reduction of waste going to landfill, in particular biodegradable waste, the Packaging Waste Directive [113], which sets recovery and recycling targets, the Incineration Directive [114] which sets emission limit values for incinerators, and the ELV [115] and EEE [116] Directives, which set recovery, recycling and reuse targets and take-back obl ...[+++]igations for end-of-life vehicles and electronic and electrical equipment respectively.

In particular, the 1981 Hallmarking Act and the hallmarking regulations of 1983 and 1990 give rise to a number of problems such as a limited range of recognised standards of fineness, the obligation to use either a hallmark recognised internationally by the Vienna Convention (to which not all Member States are signatories) or a hallmark of the Dublin Office, the obligation for imported objects to carry a "sponsor's mark" registered in Ireland and the fact that the hallmarks imposed on imported objects differ from those used for objects made in Ireland.

It also lays down conformity assessment procedures and rules concerning the striking and content of marks and nominal fineness ranges for each precious metal.
