Il a ajouté : « Que l’article 36(2) du Règlement soit maintenu ou abrogé, cela ne changera rien au pouvoir de délivrer des permis et d’en fixer les conditions ni à celui d’obliger leurs titulaires à respecter ces conditions.
The Standing Joint Committee for the Scrutiny of Regulations responded to the concern by affirming that “disallowance of [section 36(2)] may change the manner of enforcing compliance with terms and conditions of licences, but would certainly not affect in any way the ability to impose such terms and conditions” (8) The Committee further stated that “Whether or not section 36(2) remains in the Regulations, the authority to issue licences and to impose terms and conditions on the licence would remain unimpaired, as would the ability to enforce observance of those terms and conditions.
